Welcome to Universal Fitness Group Pty Ltd (hereafter U.F.G.), these Terms and Conditions have  been prepared to provide a safe and comfortable environment for all our members and staff.  Everyone, including staff and members at U.F.G., must comply with the Terms and Conditions of the  Club. 

This agreement applies to all members who make a purchase either in a U.F.G., or via a U.F.G.  website. The content of the pages in these Terms and Conditions or on the Website, are for your  general information and use only. Any content is subject to change without notice.

1. MEMBERSHIP TYPES 

1(a) U.F.G. provides three tiers of membership: 

1. Blue Label 

2. Gold Label 

3. Red Label 

1(b) MEMBERSHIP COMMITMENT TYPES 

● 3 Months 

● 6 Months 

● 12 Months 

● PAYG (Pay As You Go) 

1(c) CORPORATE MEMBERSHIP 

U.F.G. has preferred corporate partners. If you are an employee of the Company with which we have  a separate corporate agreement, you will be entitled to the corporate discount. On presenting your  corporate Identification or a current payslip or proof that qualifies you for a concession. 

1(d) DISCOUNTED MEMBERSHIP 

You will receive a discounted membership if you are a: 

● Student – to qualify, you must provide proof that you qualify for a concession before the  membership anniversary of each year. If you no longer satisfy the criteria, we 

can upgrade you to the standard membership. Before we change your contract, we will contact you  in writing to about any changes to your fees. If you are out of your membership contract term, you will  be able to cancel your membership by providing us with ONE months’ notice. 

● Seniors Card Holder – to qualify, you must provide proof that qualifies for this Concession. 

2. AGE RESTRICTIONS

2(a) You must be at least 14 (FOURTEEN) years of age to qualify as a member of U.F.G. 

2(b) If you are under 16 (SIXTEEN) years of age, a parent or guardian must sign your  membership agreement as well as completing and signing the Health Questionnaire. 

You can then: 

• Use the cardio equipment 

• Take part in group fitness classes which do not use weights 

[You may not perform unsupervised resistance training nor take part in group classes which  use weights (including circuits and boxing type exercises).] 

2(c) If you are 16 or 17 years of age, a parent or guardian must co-sign your agreement and  health questionnaire. 

You may then perform unsupervised resistance training once a qualified staff member has assessed  your health questionnaire. 

2(d) Except as otherwise specified in this Agreement, you acknowledge and agree, that under no  circumstances, are you permitted to bring children into the Club nor are you  

permitted to leave children unattended in the Club. We shall not be liable, in any manner, for  any injury, loss or damage sustained as a result of your failure to comply with these conditions and  you agree to indemnify us and hold us harmless for any loss  

and/or damage we may suffer as a result of your breach of (this clause) these conditions. 

3. MEMBERSHIP 

3(a) The Membership agreement with us takes effect when you have signed the Agreement and have accepted the terms and conditions of the membership. 

3(b) (Every time you enter) Upon entry into our Clubs, please present your Membership Card to a member of staff at reception. 

3(c) Upon joining, you will receive an access card. The member’s photo will be attached to their  account on our digital membership database. Without a valid access card or photo Identification,  entry will be refused. 

3(e) Should you misplace your membership card; you will be liable to pay $10.00  replacement fee. 

3(f. If your membership dues are not kept up-to-date, or your membership becomes  frozen, suspended or terminated, Club access will be denied. 

3(g) Cooling off – Should you change your mind after joining, you have 7 (SEVEN) days to cancel  your membership. In order for this to become effective, you must provide us with your decision, in  writing, at any time within the 7-day cooling off period. Your written cancellation can be given to us in  person, by post or by email. The member shall be entitled to a full refund of any membership fees  paid; however, the start-up fee $99 is not refundable.

3(h) In the case you decide to cancel your membership (as per clause 3g), the cooling off period  shall apply for a new membership only and does not apply for membership transfers or renewals. 

3(i) Membership fees is payable on an ongoing basis in advance each week, payable by direct  debit or credit card. 

3(j) An upfront payment can be made for the membership. The payment needs to be made  on the same day the membership is purchased. 

3(k) Membership Agreements Terms and Conditions may, at times, be added to, changed, or  clauses removed. This includes the club’s trading hours, its services and  

facilities, and membership fees. On occasion, we may close the club for the purposes of  refurbishment to improve facilities. Your membership fees will not be reduced should the Club be  closed on public holidays nor for the purposes of refurbishment. 

3(l) At the discretion of management, membership fees will automatically increase at a rate of  3%, at the expiration of the term of your agreement and this increase will be notified to you in an email  at least 14 days in advance. 

3(m) Update your contact details when they change so that we can keep in touch with you. 

3(n) We are to be notified immediately of any bank or account details so we may timeously  update our records. Failure to do so may result in reversal fees being incurred. 

3(o) You acknowledge that it is your responsibility to cancel direct debit facilities in respect of  your membership when this Agreement expires or is terminated. 

3(p) It is your responsibility to inform us in writing, in full detail, should you believe that any club  activities may be a risk to your health. 

4. MEMBERSHIP ENQUIRIES 

4(a) All Member enquiries and comments about the service provided under this Agreement should be directed to the Club via contact details provided in the website. 4(b) All member enquiries in regard to Direct Debit billing should be directed to DebitSuccess – is DebitSuccess Pty Ltd, PO Box 577, Mt Waverley, VIC, 3149, Phone – 

1800 148 848 Fax – 1800 777 084, e-mail: memberservice@debitsuccess.com are the nominated  debiting agent by U.F.G to directly debit the nominated bank account or credit card for  any instalments or fees due under the terms and conditions of this Agreement and Direct Debit  Request. 

4(c) Members acknowledge that DebitSuccess has been engaged by U.F.G. to collect outs tanding fees due under this agreement and also acknowledges that all the rights of the Club, under  this Agreement, are able to be enforced by DebitSuccess as if it were U.F.G., without any  involvement on the part of the Club. 

5. MEMBERSHIP “Suspensions”

5(a) Membership can be placed on “suspension” for a minimum period of 2 (TWO) weeks and a  maximum period of 3 (THREE) months (equivalent to 12 weeks) in each calendar year. A  “suspension” fee of $10.00 per week will apply to all memberships, which you will pay in advance or  by direct debit. 

5(b) Placing your membership on “suspension” within your minimum term, will extend the end  period of the minimum term by the amount of the time your membership has been placed on  suspension. 

5(c) Before suspending your membership, you need to ensure your fees are up to date and no  monies are outstanding to U.F.G. 

5(d) Membership suspension cannot be backdated, you will be required to notify the Club prior to  the next direct debit. 

5(e) Should your membership suspend be due to a medical condition; you will not be  charged the suspension fee. However, the medical condition needs to be in writing, accompanied by  the supporting documents from the medical practitioner, stating that you are unable to exercise. You  agree that we may contact your doctor, or any other practitioner for verification purposes. 

6. MEMBERSHIP TRANSFERS 

6(a) You may transfer your membership, in writing, to another person, within the remaining  minimum Term of your Agreement. This must be done in person at the Club with the transferee. 

6(b) Transferee should not be a current member. 

6(c) Transferee has not been a member in the last 6 (SIX) months. 

6(d) Transferee pays the transfer fee equivalent to the start-up fee. 

6(f) Transferee will not have been previously banned from U.F.G. or failed to pay membership  fees. 

6(g) A membership transfer is only effective when the transferee has completed the sign- up  process and paid the transfer fee which is equivalent to start-up fee. 

6(h) A membership transfer will not take place if the member transferring is out of the minimum  term or a foundation member or family or friends’ memberships. 

7. MEMBERSHIP CANCELATIONS 

7(a) During Cooling off period: 

● You may cancel your membership at any time before the close of business on the seventh  (7th) day following the commencement date. For security and identification purposes, cancellation  must be completed in person at the Club or can be done by an email but ID’s need to be sent as an  attachment with the email. 

● If you exercise your cooling-off rights under Clause 7(a), we will refund all fees already paid by  you and any other fees for services provided.

7(b) Medical Condition: 

● You may cancel your membership at any time by informing us, in writing, if you  cannot use the facilities and services due to contracting a serious illness or a permanent  physical incapacity during the term of your membership. This must be confirmed  in writing by a doctor or other medical professional we reasonably agree to and you agree that  we may contact the doctor or other professional for verification purposes. 

7(c) At the conclusion of your Membership Agreement, the Agreement will continue until  terminated by yourself, in writing. 

7(d) You acknowledge and agree that, except as otherwise set out in this Agreement, or as  required by law, all fees are non-refundable upon termination of this Agreement and your failure to  use facilities and services, does not warrant early termination of this Agreement nor does it warrant a  refund of any type. You further acknowledge and agree that failure to use the facilities and services  does not affect any of the terms of this Agreement. We are in no way responsible for your level of  usage nor is it our responsibility to notify you of your usage at any stage. 

7(e) Cancelling after the minimum Term: 

● Once the minimum term of your membership expires, you may cancel your  membership by giving 30 days’ notice as per Clause 7(c). When you cancel, you must settle any fees  you owe. Should this not occur, we will be forced to take action to recover outstanding monies. 

● We count this period from the date of your request. This means that your final debit may be a  pro rata amount. 

● You cannot freeze your membership payments during the notice period. 

7(f) Cancelling within the minimum Term: 

● If you are sick or incapacitated (refer Clause (7b)) – you are obliged to present  to us a certificate from a registered medical practitioner, stating that you cannot exercise for the  rest of your term. 

● Should you become bankrupt – you must provide us supporting documentation. 7(g) Cancelling within the Minimum Term for Other Reasons: 

During the minimum term, you may cancel your Membership at any time by informing us in writing and  paying the penalty cancellation fee which is equivalent to 50% of your remaining term. 

7(h) Prepaid Membership: 

● Any prepaid amount for the membership, within the minimum term, will be refunded as  per Clause 7(g). 

● Prepaid memberships will automatically terminate when the term of the prepaid membership  comes to an end. 

8. CONDITIONS OF CLUB ENTRY

To assist us in maintaining a safe and comfortable environment for all members and staff, please  abide by the following conditions. Failure to abide by these conditions may result in the suspension or  termination of your membership. 

8(a) U.F.C. is a non-smoking facility. This condition includes smoking anywhere within close  proximately of the Clubs. 

8(b) No food or beverages are to be brought from outside our Clubs. 

8(c) U.F.G. has a zero tolerance for the use or possession of alcohol, anticoagulants,  antihistamines, beta blockers (unless you provide a letter from a registered doctor), narcotics or  tranquillisers on any of its premises. 

8(d) No alcohol or illegal substances are to be brought into any of our Clubs (as per Clause 8(c)). 

8(e) Please ensure you leave the premises punctually. Our Clubs will not open prior to the  advertised hours. 

8(f) The use of cameras or videos are not permitted on the premises without prior written  permission. 

8(g) Dress code – for safety reasons, fully enclosed, clean sports shoes must be worn at all  times while training including when moving between classes and change rooms. Members are  required to wear a singlet or t-shirt at all times Clothing must be clean and tidy with no offensive prints  or designs for the consideration of other members. 

8(h) Sauna and Steam Room Dress Code – swimwear and a towel must be worn at all times. Members must be 18 years. The wet areas are unsupervised, and you use them at your own risk. 

8(i) If a laundry service is part of your membership, only clothes worn whilst training in the Club.  We do not wash undergarments. Please label any clothes clearly with your name. It is your  responsibility to check washing instructions. If you fail to do so, you may not claim for any losses,  damage or costs. 

8(j) Towels have to be used all times while using Club equipment. 

8(k) Special Conditions – please refer as mentioned when signing up to be a member in our Club. 

8(l) No Bags are permitted on the gym floors. 

8(m) Member Behaviour – be respectful, do not behave inappropriately towards other  members, guests, our staff and outside providers. The following applies – 

– Verbal or Physical Intimidation; 

– Harassment; 

– Discrimination on the basis of race, gender, age or any disability.

9. LOCKERS 

9(a) Lockers have been made available and are located in the change rooms. 

9(b) Lockers are available for the purposes of storing your gear while using the Club  (subject to availability). We can not guarantee that the use of a locker will prevent theft or damage to  your personal belongings. 

9(c) Lockers may only be used for appropriate items, for example, gym kits, toiletries and the  clothes you wore on arrival at our Clubs. Please do not store any other items in your locker. If we  have reasonable grounds for suspecting that a locker is being used for any other purpose, we reserve  the right to open it and remove any offending items. 

9(d) We cannot accept responsibility for any loss or damage to your belongings whilst you are  using our facilities, including your locker being tampered with by a member or if someone breaks into  your locker. Please do not bring valuables into the Club. 

9(e) All lockers will be opened overnight for the purposes of being cleaned. Any gear left in  lockers overnight will be removed. If it’s not collected in 7 (SEVEN) days, these items will be donated  to charity. 

10. GYM FLOOR, STUDIO AND MEDITATION ROOM 

10(a) Equipment is to be used for its intended purpose. Follow the instructions provided, including  instructions given by our staff. Ask for help if you need it. Please do not bring your own equipment into  our Club. Items such as boxing gloves and yoga mats are 

accepted. If you are unsure of what you can bring, check with our staff. Be sure to inform us  immediately if any of our equipment becomes broken or unsafe to use. 

10(b) No food or bags on the training floor, studios and mediation room. 

10(c) Only drinks in plastic, aluminium or glass bottles (with cover) containing water or  sports drinks are permitted onto the training and studio floors. Please take extra care with glass  bottles. 

10(d) Please be respectful to other members by replacing weights and equipment after use. 

10(e) A towel must be used on all equipment while in the studio, mediation room, and on the  training floor. Please wipe down equipment after use. 

11. PERSONAL TRAINER 

11(a) Personal Trainers at U.F.G. are franchisees and any services they provide is a contract  between them and yourself. We cannot accept any responsibility for a breach of contract or  negligence. 

11(b) Should you make a claim against the Personal Trainer, your claim needs to be brought  against the Personal Trainer in their personal capacity. You release us from any claim resulting from  an act or omission by a Personal Trainer.

12. HEALTH AND SAFETY 

12(a) Fire doors and fire exits are to be clear at all times. 

12(b) In the case of an emergency or when an announcement is made, both should be taken  seriously. The Club’s staff instructions are to be abided by at all times. Failure to do so will deem you  to be in breach of U.F.G. rules. 

12(c) On the day your membership agreement is signed, you are confirming that: ● you are in good physical condition; 

● you are not aware of a medical condition, or other reason why you cannot or should not do  active passive exercise. 

12(d) Our staff and personal trainers are not medically trained. They are not qualified to assess  whether you are in good physical condition and can exercise without risking your health, safety or  comfort. If you have any doubts, we strongly urge you to seek expert advice before starting an  exercise program. 

12(e) You acknowledge that whilst we make every attempt to ensure that the services and  facilities provided by U.F.G are safe, there are some significant and inherent risks involved, and you agree that you are participating voluntarily, at your own risk and responsibility, thereby  exposing yourself to certain risks. 

13. SECURITY 

13(a) CCTV – All our premises are monitored by CCTV security cameras recording 24 hours a day  (excluding change rooms, sauna and steam room) and may have remote video or other guarding  devices. This system is used for security purposes but does not guarantee against harm. You should  contact the Club if you have questions on this. 

14. PRIVACY 

14(a) We respect your privacy. We do not pass your information to any third party. If you  do not wish to receive special offers or promotions by email, SMS or mail  correspondence from us regarding your membership, then please send us an email or letter  confirming that you wish to unsubscribe from such methods of communication. 

14(b) Please contact us for a copy of our privacy policy. 

15. COMPLAINTS AND FEEDBACK 

15(a) If you have any concerns about the Facilities and Services or anything else in relation to your  membership, you should first raise it with our Club Staff. 

15(b) If you do not feel uncomfortable approaching, or do not wish to approach Club Staff,  or you are not satisfied with a response you have received, you may send your complaint or  query by email to info@universalfitnessgroup.com.au

15(c) We will do all that is reasonably and practicably possible to assess the merits of the  complaint and respond within a reasonable timeframe. 

16. OTHER MATTERS 

16(a) Unforeseen Events – We are not responsible if members are not able to use our Club or  facilities because of an event caused by a natural force (such as a fire or flood), a road or  building closure, or anything similar beyond our reasonable control. If this continues unforeseen  event lasts for more than 30 days, then either you or we may cancel this Agreement immediately by  written notice. No Fee will apply. 

16(b) U.F.G. may occasionally take photographs/images of the Club and its facilities (including members). We will endeavour to do our best to get your permission 

beforehand, but this may not always be possible. We reserve the right to use these  photographs/images for commercial purposes without payment. We use CCTV to monitor any  incidents at our Clubs. 

16(c) Club Price Lists may change from time to time. 

Important information about your membership: 

• Membership requires 30 days’ notice to cancel after the minimum contract term. • If you wish to cancel your membership during your contract you must either pay 50% of the  remaining contract or 4 weeks’ notice, whichever is greater. 

• A suspension fee of $10.00 does apply to all memberships , minimum 2 weeks, and  maximum of 3 months. 

• All late transactions will occur a $14.95 penalty fee.
